Terms & conditions
The agreement between you and CogniResume.
These Terms explain what you can expect from CogniResume and what we expect from you when you use the extension, the website, and the related services. Please read them carefully — by using CogniResume, you agree to them.
Overview
CogniResume (“CogniResume”, “we”, “us”) provides an AI-assisted resume tailoring product, made available through a Chrome extension, a companion website at cogniresume.com, and related backend services (together, the “Service”). These Terms & Conditions (the “Terms”) form a binding agreement between you and CogniResume governing your use of the Service.
If you do not agree with these Terms, please do not install the extension, create an account, or otherwise use the Service.
Eligibility
You may use the Service only if you are at least 18 years old, or the age of majority in your country of residence (whichever is higher), and have the legal capacity to enter into a contract. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.
You are responsible for ensuring that your use of the Service is permitted under the laws of the country from which you access it.
Your account
- You create an account by signing in with Google. You agree that the information associated with your Google account is accurate and that you are the legitimate owner of that account.
- You are responsible for activity that happens under your account, including for keeping your device and Google account secure.
- You may close your account at any time. Closing your account removes your stored resumes and tailored versions from production systems within the timeframe described in our Privacy Policy.
- One person, one account. Creating multiple accounts to abuse free credits or to evade a suspension is a breach of these Terms.
Credits, payments & refunds
Some features of the Service are paid and consume “credits”. Credits are a prepaid unit of access — they are not money, do not earn interest, and cannot be redeemed for cash or transferred between accounts.
- Purchasing credits. Credit purchases are processed by Stripe. When you buy a credit pack, you authorise Stripe to charge the payment method you provide for the amount shown at checkout, including any taxes.
- Pricing & taxes. Prices are shown at checkout in the currency offered by Stripe Checkout and may include or exclude VAT depending on your location. We may change prices for future purchases at any time; price changes do not affect credits you have already bought.
- Credit expiry. Unless we say otherwise on the purchase page, credits do not expire while your account is active.
- Failed generations. If a credit is consumed but the Service fails to deliver a usable output due to a problem on our side, we will refund the credit to your balance once we confirm the failure.
- Refunds. Refund requests are reviewed on a case-by-case basis. To request a refund, email support@cogniresume.com with your order details and the reason for the request, and we will respond within a reasonable time. Statutory consumer rights that apply to you (including any right of withdrawal under EU or German consumer law) are not affected by this paragraph.
- Right of withdrawal & immediate execution. EU consumers normally have a 14-day right of withdrawal for digital content. By starting to use credits before the 14-day period ends, you expressly request immediate execution of the contract and acknowledge that this may, to the extent the credits have already been consumed, cause your right of withdrawal to lapse under §356(5) BGB. Unused credits remain refundable on request as described above.
- Chargebacks. If you initiate a chargeback that we believe is unjustified, we may suspend your account and recover the disputed amount and any associated fees.
Acceptable use
When using the Service you agree not to:
- Use the Service to create or distribute content that is illegal, fraudulent, defamatory, harassing, or that infringes someone else's rights.
- Submit content you do not have the right to submit (for example, another person's resume without their consent, or job descriptions you are contractually prohibited from sharing).
- Misrepresent your identity, qualifications, or employment history in a way intended to deceive an employer — the Service is for tailoring genuine experience to a role, not for fabricating it.
- Reverse engineer, decompile, or attempt to extract the source code of the extension or backend, except to the extent expressly allowed by mandatory law.
- Scrape, probe, overload, or otherwise interfere with the Service, including by sending automated requests outside what the product UI generates.
- Use the Service to build a competing product, or to train another machine-learning model on our outputs.
- Bypass paywalls, abuse free credits (e.g., by creating multiple accounts), or circumvent security or rate-limiting controls.
We may investigate suspected breaches and take any action we consider appropriate, including warning you, removing content, limiting features, or suspending your account.
AI-generated content
The Service uses large language models from third-party providers to generate tailored resumes, fit scores, keyword lists, and similar outputs. AI-generated outputs may contain mistakes, omissions, outdated information, or claims that do not match your actual experience.
- You are the author. Before sending any AI-generated resume or cover-letter content to an employer, you are responsible for reviewing it for accuracy, completeness, and truthfulness. Submitting inaccurate information to an employer is your responsibility, not ours.
- No employment guarantees. CogniResume does not guarantee that using the Service will result in interviews, job offers, or any particular outcome with any employer or applicant-tracking system.
- Similar outputs. Because the underlying model is shared across users, outputs generated for different people may coincidentally resemble each other. We do not guarantee uniqueness of generated text.
- Provider behaviour. The underlying AI providers may change, deprecate, or behave differently over time. We will make reasonable efforts to maintain quality but do not promise a specific model, version, or capability set.
Your content
You keep ownership of the resume content, job posts, and other inputs you submit to the Service (“Your Content”). By submitting Your Content, you grant CogniResume a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and process Your Content solely so we can operate, support, and improve the Service for you — for example, to send the content to an AI provider for tailoring and to display the result back to you.
We do not sell Your Content and we do not use it to train third-party models. The licence above ends when you delete the content or close your account, except for limited backups and records we are required to keep.
You confirm that you have the right to submit Your Content and that doing so does not violate any law, contract (e.g., a non-disclosure agreement with an employer), or third-party right.
Our intellectual property
The Service, including the extension, website, backend, design, logos, and underlying software, is owned by CogniResume or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the extension and access the website for your own job-search activity, subject to these Terms.
Nothing in these Terms transfers ownership of the Service or any part of it to you. You may not copy, distribute, modify, or create derivative works of the Service except as expressly allowed in writing or by mandatory law.
Third-party services
The Service depends on third-party providers including Google Sign-In, our cloud-hosting provider, Stripe (payments), and AI model providers such as OpenAI. Your use of those providers' services is also governed by their own terms and privacy policies. We are not responsible for outages, errors, or policy changes by third-party providers, except to the extent required by mandatory law.
Suspension & termination
We may suspend or terminate your access to the Service if you breach these Terms, if your use creates risk or legal exposure for us, or if we are required to do so by law. Where it is reasonable to do so, we will give you notice and an opportunity to fix the issue.
You may stop using the Service at any time by uninstalling the extension and/or closing your account. Sections that are intended to survive termination (such as the disclaimers, limitation of liability, and intellectual property provisions) will continue to apply after termination.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-generated outputs, or that the Service will be uninterrupted, error-free, or secure.
This section does not exclude or limit warranties that cannot be excluded or limited under the law applicable to you, including statutory consumer rights.
Limitation of liability
To the maximum extent permitted by law, CogniResume is liable without limitation only for damages caused by intent or gross negligence, for personal injury, and where mandatory liability applies (for example, under the German Product Liability Act). For damages caused by simple negligence, our liability is limited to the breach of essential contractual obligations (“Kardinalpflichten”) and to the foreseeable damage typical for this kind of contract.
Subject to the paragraph above, our aggregate liability arising out of or relating to the Service in any 12-month period will not exceed the greater of (a) the amount you paid CogniResume for credits during that period, or (b) €50.
Nothing in these Terms limits any liability that cannot be limited under applicable law. If you are a consumer in the European Union, your statutory rights remain unaffected.
Changes to these Terms
We may update these Terms from time to time — for example, to reflect new features, legal requirements, or pricing models. When we make material changes, we will update the “Last updated” date and, where it makes sense, notify you in the extension or by email before the changes take effect. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not accept them, you can stop using the Service and close your account.
Governing law & disputes
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer with habitual residence in another country of the European Union, you also benefit from any mandatory provisions of the law of that country that cannot be derogated from by agreement (Article 6 of Regulation (EC) No 593/2008, Rome I).
We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German VSBG. Consumers may nevertheless bring claims before the competent courts of their place of residence or of our place of business, as applicable.
